Hollister Homeowner Shoots Armed Burglar

Hollister, California – A Hollister homeowner shot an armed burglar at around 6 a.m. on May 10. She awakened to find a man with knives and a machete in her walk-in closet. She is the mother of two children – her husband says she went into “mama bear mode.” After demanding he leave, she fired several warning shots, then he advanced on her position, so she shot him in the leg. The suspect was identified as a man named Ocean Burger (actual name), 18. The Hollister address is a gated community called Montebello Estates. The gate didn’t stop the suspect.

Investigators say Burger was armed with several knives and a machete when the mother confronted him inside her closet. They say Burger ignored orders to leave and when the homeowner fired several warning shots he allegedly advanced towards her, that’s when the mother fired at the accused burglar hitting him in the leg. And California law may be on her side.

“There is a presumption that favors the homeowner they’re presumed that the person is in imminent fear of either death or great bodily injury,” said Ellen Campos, assistant district attorney for San Benito county.

“You got somebody nuts in the head inside your house I don’t know if he had a knife I thought I heard maybe he had a knife you just can’t stand still and do nothing,” said Postigo.

Investigators say they will not recommend any charges be filed against her.


The alleged burglar is charged with Burglary, Possession of Burglary tools, and is being held on a $40,000 bond at the San Benito County jail.

Warning shots may not always be a good idea because of the very situation this Hollister homeowner found herself in – the suspect “advanced” on her after she fired them. Verbal warnings should be sufficient. If they do not comply, it’s time to take them down. If a suspect is already inside your walk-in closet and is armed with knives and a machete, then that person likely means to cause you and your family harm. Shooting them in the leg may or may not stop the suspect’s advance, especially when they are armed. This Hollister homeowner is fortunate that her efforts worked well and her shot was able to stop his advance.
